The investment company Bagger-Sørensen Equity A/S is new, but it has 107 years of experience as part of the Bagger-Sørensen family business, who founded the golden eggs Dandy and Fertin Pharma.

BS Equity was established two years ago as an investment company with an industrial approach and looking for long-term investments. In a short time, 65 investments and 43 acquisitions have been made, and the goal is 7-10 primary investments in the longer term.

Health and global goals

The investment company has 4 themes dealing with health, trends in consumer behavior and food, technology in production and sustainability. In addition, at least one of the UN's Global Goals must be included in a purchase or investment.

- Our history with pharmaceutical products means that we have extensive experience and knowledge in these areas. The more themes we can tick off, the better. One of our investments is a company that develops equipment for replacement of traditional pasteurization, and here we can tick all themes, but it's not like that every time, says Søren Birn.

He is a former CEO of Gumlink A/S and Fertin Pharma A/S, and he is very much aware of the daily challenges in the industry seen from the executive chair, which increases BS Equity's competences in working with them.

- We bring experience from managing and we are aware of the day-to-day operations. You cannot manage a company by using an Excel sheet, as it is people and processes that must work together. Everything does not always go smoothly, but if you get the right people to play together with systems and have a clear strategy, it is a good starting point, says Søren Birn.

- In some cases, we look closely at whether there are inventions and how they can possibly be protected with patents. The product may be smart, but if it can be easily copied, it may not be a good investment. It is also important with differentiation in the market and a suitable risk profile. Challenge patent rights

BS Equity use the expertise of advisers in connection with applications for new patents, but just as often when it comes to a company's ability to act without infringing other patent rights, also called "freedom-to-operate". This is where the risk profile with IPR is assessed.

- We need to know the extent to which we are free to act commercially in relation to existing patents from competing companies. We will be presented with some scenarios in relation to patent legislation and how to challenge a patent. If it is assessed that there is no "freedom-to-operate", it is of course a challenge to proceed with the investment, says Søren Birn.

BS Equity has been given advice from Kanved Patent Consulting in connection with challenging a patent on the American market, where, after further investigation, it turned out that there were some opportunities to design around the patent, which led to a successful investment.
